1. Acceptance of Terms

By creating an account, submitting a booking, or using any part of the Peakly platform ("Service"), you confirm that you have read, understood, and agree to these Terms of Service ("Terms") and our Privacy Policy.

If you are under 18 years of age, your parent or guardian must read and agree to these Terms on your behalf. By using the Service, your parent or guardian confirms their agreement.

2. Our Services

Peakly is an online marketplace that connects students with independent tutors. We facilitate bookings and communication, but we are not a party to the tutoring relationship itself. Tutors on our platform are independent professionals, not employees of Peakly.

We reserve the right to modify, suspend, or discontinue any part of our Service at any time with reasonable notice where possible.

3. User Accounts & Eligibility

To use core features of Peakly, you may be required to provide personal information including your name and email address. You agree to:

• Provide accurate and truthful information
• Keep your contact information up to date
• Not misrepresent your identity or qualifications
• Not share your account with others

You must be at least 13 years old to use Peakly independently. Users under 18 require parental consent.

4. Rules for Students

As a student using Peakly, you agree to:

• Attend or cancel sessions with reasonable notice (at least 24 hours where possible)
• Treat tutors with respect during all sessions and communications
• Use the platform only for legitimate educational purposes
• Not record sessions without the explicit consent of your tutor
• Pay for sessions as agreed with your tutor

5. Rules for Tutors

As a tutor on Peakly, you agree to:

• Provide accurate information about your qualifications, experience, and subject expertise
• Deliver sessions professionally, punctually, and to the best of your ability
• Maintain appropriate professional boundaries with all students, especially minors
• Comply with all applicable Australian laws, including those relating to working with children
• Not solicit students to contact you or pay you outside of the Peakly platform
• Keep student information confidential

Peakly reserves the right to remove any tutor from the platform at any time if these standards are not upheld.

6. Payments & Refunds

Session Fees: Prices are agreed between students and tutors. Peakly may display indicative pricing ranges, but final fees are set by individual tutors.

Satisfaction Guarantee: If you are not satisfied with your first session, contact us at hello.peakly1@gmail.com within 48 hours and we will arrange a replacement session with a different tutor at no extra cost. This guarantee applies to first sessions only.

Cancellations: Cancellations made with less than 24 hours' notice may incur a cancellation fee at the tutor's discretion.

Disputes: Payment disputes should be raised with us within 7 days of the session. We will mediate in good faith, though the final resolution may rest with the relevant payment provider.

7. Acceptable Use & Conduct

You must not use Peakly to:

• Harass, threaten, or abuse other users
• Post or share offensive, illegal, or inappropriate content
• Attempt to gain unauthorised access to our systems
• Scrape, copy, or reproduce platform content without permission
• Solicit contact details or arrange off-platform payments
• Impersonate another person or entity

Violations may result in immediate suspension or permanent removal from the platform.

8. Intellectual Property

All content on the Peakly website — including the logo, design, text, graphics, and code — is the intellectual property of Peakly and is protected by Australian copyright law.

You may not reproduce, distribute, or create derivative works from our content without prior written permission. Session materials created by tutors remain the intellectual property of those tutors.

9. Limitation of Liability

To the maximum extent permitted by law, Peakly is not liable for:

• The quality, accuracy, or outcomes of any tutoring session
• Any indirect, incidental, or consequential damages arising from your use of the Service
• Any loss of data, revenue, or academic results
• The actions or conduct of individual tutors

Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.

10. Termination

We reserve the right to suspend or terminate your access to Peakly at any time if you violate these Terms or if we have reason to believe your conduct is harmful to other users or to Peakly.

You may stop using Peakly at any time. If you wish to request deletion of your personal data, contact us at hello.peakly1@gmail.com.

11. Dispute Resolution

If you have a complaint or dispute, please contact us first at hello.peakly1@gmail.com. We will make every effort to resolve your issue promptly and fairly.

These Terms are governed by the laws of the State of Victoria, Australia. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, where material changes are made, we will notify active users by email.

Continued use of Peakly after updated Terms are posted constitutes your acceptance of the revised Terms.
